Note: USCIS has designated the Dates for Filing chart in the Department of State Visa Bulletin for employment-based adjustment of status applications and the Dates for Filing chart for family-sponsored adjustment of status applications within the U.S. for October 2023.

Below are some key changes for the employment-based preference categories this month:

Dates for Filing for Employment-Sponsored Cases:

• EB1:
  • EB1 China moves forward 6 months from 02/01/2022 to 08/01/2022.
  • EB1 India moves forward 7 years from 01/01/2012 to 01/01/2019.
  • All other EB1 moves forward from 08/01/2023 to current.
• EB2:
  • EB2 China moves forward 5 months from 07/08/2019 to 01/01/2020.
  • EB2 India moves forward 01/01/2011 to 05/15/2012.
  • EB2 Mexico moves forward 13 months from 12/01/2022 to 01/01/2023.
  • EB2 Philippines moves forward 6 months from 07/01/2022 to 01/01/2023.
  • All other EB2 moves forward 6 months from 07/01/2022 to 01/01/2023.
• EB3:
  • EB3 China moves forward 4 months from 09/01/2019 to 09/01/2020.
  • EB3 India moves forward 3.5 years from 01/01/2009 to 08/01/2012.
  • All other EB3 moves forward from 2 years and 9 months from 05/01/2020 to 02/01/2023.
• EB5:
  • EB5 China (Unreserved C5, T5, I5, R5) moves forwards from 1 year and 6 months from 09/08/2015 to 03/01/2017.
  • EB5 India moves forward 5 years from 04/01/2017 to 04/01/2022.
  • All EB5 (Set Aside Rural – 20%) remain current.
  • All EB5 (Set Aside High Unemployment – 10%) remain current.
  • All EB5 (Set Aside Infrastructure – 2%) remain current.
