Note: USCIS has designated the Dates for Filing chart for employment-based adjustment of status applications and the Dates for Filing chart for family-sponsored adjustment of status applications within the U.S. for February 2026.

• Key Employment-Based Updates While many categories remain stagnant this month, there is significant movement in the EB3 category for “All other” countries, which has moved forward 92 days to October 1, 2023.

• Key Family-Sponsored Updates The family-sponsored categories saw several targeted advancements, particularly for applicants from Mexico and those in the F2A.

Below are some key changes for the employment-based preference categories this month:

Dates for Filing for Employment-Sponsored Cases:

• EB1:
  • EB1 China remains at 08/01/2023.
  • EB1 India remains at 08/01/2023
  • All other EB1 remain current.
• EB2:
  • EB2 China remains at 01/01/2022.
  • EB2 India remains at 12/01/2013.
  • All other EB2 remain at 10/15/2024.
• EB3:
  • EB3 China remains at 01/01/2022.
  • EB3 India remains at 08/15/2014.
  • All other EB3 move forward 92 days from 07/01/2023 to 10/01/2023.
• EB5:
  • EB5 China (Unreserved C5, T5, I5, R5) remains at 08/22/2016.
  • EB5 India remains at 05/01/2024.
  • All EB5 (Set Aside Rural – 20%) remain current.
  • All EB5 (Set Aside High Unemployment – 10%) remains current.
  • All EB5 (Set Aside Infrastructure – 2%) remain current.

  • F2A for China moves forward 1 month from 12/22/2025 to 01/22/2026.
  • F2A Mexico moves forward 1 month from 12/22/2025 to 01/22/2026.
  • F2A Philippines moves forward 1 month from 12/22/2025 to 01/22/2026.
  • All other F2A move forward 1 month from 12/22/2025 to 01/22/2026.
• F2B:
  • F2B for China and India remain at 03/15/2017.
  • F2B Mexico moves forward 3 months from 11/15/2009 to 02/15/2010.
  • F2B Philippines remains at 10/01/2013.
